Terms and Conditions of Sale – OBSERVATOIRE PARIS MONTPARNASSE 

ONLINE TICKETING  

General terms and conditions

1.1.These General Terms and Conditions (hereinafter the “GTC”) apply to all Internet purchases of one or more tickets for access to and visits of the Observatoire Paris Montparnasse (levels 56 and 59), located at 33 avenue du Maine – 75015 Paris (hereinafter the “Tourist Products”) purchased by the customer via the online ticketing service (hereinafter the “Customer”), accessible at https://www.tourmontparnasse56.com/ (hereinafter the “Order”) from OPTM (33 avenue du Maine – 75755 Paris Cedex 15, RCS Paris n°838 918 944, trading as “Observatoire Paris Montparnasse” (hereinafter “Observatoire Paris Montparnasse”). 

Tourist Products may only be used on the day(s) and at the time(s) chosen by the Customer when placing the Order.  

These General Terms and Conditions can be consulted on the Paris Montparnasse Observatory website.  

1.2. The Customer declares that he/she has the legal capacity to place an Order and enter into the present contract, i.e. that he/she has reached the age of majority and is not under any form of protection. 

1.3. Placing an order implies the Customer’s express and unreserved acceptance of all the clauses and conditions set out in these GTS. Consequently, the Customer declares and acknowledges that he is fully aware of them, and hereby waives the right to rely on any other document.  

1.4. Observatoire Paris Montparnasse reserves the right to unilaterally modify these GCS at any time. The GCS applicable to the Order will be those in force on the day the Order is placed. 

1.5. The fact that the Observatoire Paris Montparnasse does not avail itself of any of the present conditions during a given period may not be interpreted as a waiver of the right to subsequently avail itself of the said condition or, more generally, of the other conditions.  

1.6. Notwithstanding the terminology that may be used, these GTC apply to the provision of services and are not intended to effect any transfer of ownership, so that none of these provisions may be interpreted as constituting a sale. 

Controls 

2.1. Orders for Tourist Products are subject to the present General Terms and Conditions of Sale and to the internal regulations of the Paris Montparnasse Observatory website, which can be accessed via the link https://www.tourmontparnasse56.com/internal-regulations/.  

2.2. the Customer will fill in the form with the details of the desired Tourist Products.  

Before definitively confirming an order, the Customer will be able to check his selection of Tourist Products and modify it at his convenience. 

The Order will only be definitively validated once the Order summary screen has been validated and the “pay” button has been clicked, after having first (i) selected the Tourist Product(s) and the day(s) and time(s) of visit, then (ii) filled in the contact information, accepted the GTC and checked the Order and finally (iii) filled in the details for payment of the Order. Once you have clicked on the “pay” button, the Order will be considered irrevocable, and may only be challenged in the cases set out below. Any corrections to the Order, whether relating to Tourist Products or contact details, must be made before clicking on the “pay” button. 

2.3 Once the Order has been registered, the Customer will be automatically redirected to a page confirming the final validation of the Order. The Customer will also receive a confirmation e-mail, to the e-mail address given in the contact details when the Order was placed.  

Only the ticket received by e-mail after the purchase confirmation e-mail is valid for access to the Observatoire Paris Montparnasse. To this end, it must be printed out or presented on the telephone by the Customer, who will use it in accordance with the provisions of article 2.6 herein. 

2.4. The Customer guarantees that his/her bank account will only be debited once by Observatoire Paris Montparnasse via its secure payment site, for the total amount of the Tourist Product Order, once the Order has been definitively validated as mentioned in 2.2 above.  

2.5. By keeping and/or printing the confirmation page or the e-mail sent by Observatoire Paris Montparnasse, the Customer holds proof of his/her Order.  

2.6.. Holders of special tourist products such as children’s tickets, student and youth tickets, and tickets for people with reduced mobility must present proof of entitlement to the ticket inspector.   

2.7. The sale of the Observatoire Paris Montparnasse Tourist Product corresponds to the provision of leisure activity services which must be supplied on a specific date, within the meaning of article L. 221-28 12° of the French Consumer Code. Consequently, in accordance with this article, the Customer acknowledges that he/she may not benefit from a right of withdrawal for the contract relating to his/her purchase. Any purchase of a Tourist Product is firm and definitive, and may not be withdrawn by the Customer.  

Any Tourist Product purchased cannot be taken back or reimbursed, even in the event of loss, theft or omission during the visit.  A duplicate may be issued to the customer on presentation of the order confirmation e-mail.   

General rules relating to the sale of Tourist Products 

3.1. No Tourist Product subscribed by the Customer for access to the Montparnasse Tower Observatory may give rise to any special advantage in the event of overcrowding.  

The Customer acknowledges and accepts that certain activities indicated in the description on the Paris Montparnasse Observatory website may be cancelled, in particular for climatic reasons, in the event of force majeure or in the event of a stay outside the tourist season.  

Cancellation of any activity for reasons of force majeure or due to the behaviour of a third party to the contract between the customer and Observatoire Paris Montparnasse shall not, in any event, result in Observatoire Paris Montparnasse paying any compensation to the customer.    

3.2. Prices  

The descriptions of the Tourist Products presented on the online ticketing service specify, for each Tourist Product, the services included in the price. Prices are given in Euros and include all taxes, unless otherwise stated on the ticket.  

As a general rule, and unless expressly stated otherwise, the prices of the Tourist Products do not include insurance or any personal expenses (catering, drinks, tips, etc.) and more generally any service not expressly mentioned in the description of the Tourist Products as presented on the online ticketing service.  

Prices shown on the online ticketing service may be modified at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations previously accepted by Observatoire Paris Montparnasse. 

3.3. The only method of payment accepted for Orders subject to these GCS is by bank card (Carte Bleue, Visa, Eurocard/Mastercard and American Express cards are accepted). Payment of the price of the Tourist Product via the website is made directly to Observatoire Paris Montparnasse, using the customer’s credit card number and a secure payment system.  

3.4. Observatoire Paris Montparnasse will issue a summary receipt showing the date and amount of the sums paid by the Customer for the Tourist Product purchased. 

3.5. Exchange/modification  

Any modification/exchange of a Tourist Product by the customer may be made directly on the website (https://www.tourmontparnasse56.com/fr/echange/), once only and subject to the availability of the Tourist Product selected. The exchange may lead to a change in the price of the Tourist Product according to the current price list.   

Except in cases of force majeure, in the event of cancellation of the Touristic Product by the Customer, all sums paid by the Customer to Observatoire Paris Montparnasse will be retained by the latter, without prejudice to any damages that the Customer may claim as a result of the prejudice suffered as a result of the cancellation.  

3.6. Photos and illustrations  

Every effort is made to provide photos and illustrations giving the Customer an overview of the Tourist Products offered. 

Obligations of the parties 

4.1 Observatoire Paris Montparnasse undertakes to carry out the Tourist Product Order, subject to the provisions of article 7 below and the CLIENT’s compliance with the procedure set out in article 2 above.  

4.2. In the event that Observatoire Paris Montparnasse finds itself, after the final validation of the Order, unable to fulfil its obligations for reasons other than force majeure, Observatoire Paris Montparnasse reserves the right, in order to guarantee as far as possible a product that meets the customer’s expectations, to modify the services as initially indicated for the Tourist Product concerned, provided that these correspond to the customer’s expectations; where applicable, Observatoire Paris Montparnasse must inform the Customer in good time of any modification so that the Customer can consent to the modification proposed by Observatoire Paris Montparnasse. 

4.3. All visitors must comply with the house rules posted at the entrance to the premises included in the Tourist Product.  

4.4. The Customer undertakes to comply with any instructions issued by Observatoire Paris Montparnasse concerning the organization of the Touristic Product.  

Responsibilities 

Observatoire Paris Montparnasse may exonerate itself from all or part of its liability by proving that the non-performance or poor performance of the contract and the corresponding services is attributable either to the Customer or to force majeure. 

5.1. The customer will be held responsible for any damage, direct or indirect, that he/she may cause during his/her presence at Observatoire Paris Montparnasse, whether to Observatoire Paris Montparnasse staff and/or customers, or to any equipment made available to the customer by Observatoire Paris Montparnasse.  

5.2. Insofar as permitted by applicable law, Paris Montparnasse Observatory declines all responsibility for damages of any nature whatsoever that may be caused to the Customer. In fact, each Customer is responsible for any damage, direct or indirect, that he/she may cause during his/her presence at Observatoire Paris Montparnasse. 

5.3. The Observatoire Paris Montparnasse cannot be held responsible in the event of loss or theft of the Tourist Product. However, a duplicate may be issued at the dedicated ticket office upon presentation of proof of identity, identification and reservation date, provided that the Tourist Product has not already been used.  

Force majeure 

Observatoire Paris Montparnasse reserves the right, without payment of any penalty or indemnity whatsoever, to cancel the Tourist Product and therefore access to Observatoire Paris Montparnasse if it is forced to do so by events of force majeure, as defined by law and jurisprudence, or by an act of God. 

Similarly, Observatoire Paris Montparnasse reserves the right to modify, without payment of any penalty or indemnity, the programming at Observatoire Paris Montparnasse if it is forced to do so by events of force majeure, as defined by law and jurisprudence, or by an act of God.  

Applicable law, claims and disputes 

7.1. These GCS are governed by French law.  

7.2. Any complaint in connection with these GTC must be sent by the Customer via the contact form: https://www.tourmontparnasse56.com/fr/contact specifying the Order number and the reasons.  

  

Consumer ombudsman – Online dispute resolution 

After having referred the matter to the Observatoire Paris Montparnasse and in the absence of a satisfactory response within 60 days, the Customer may refer the matter to the Tourism and Travel Mediator, whose contact details are as follows: Association de Médiation Tourisme Voyage, 15 avenue Carnot – 75017 Paris, whose contact details are available on its website: https://www.mtv.travel/saisir-le-mediateur/  

 In addition, and in accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union, accessible at the following link: https://webgate.ec.europa.eu/odr/
